Before the keys,
the questions.
Due diligence in Goa requires verifying the Form I & XIV title tracks, verifying the Sanad land conversion certificate, checking Regional Plan zoning, checking CRZ boundaries (Coastal Regulation Zone), and searching for Mundkar tenancy claims.

Unlike other Indian states, Goa has a unique history of land administration, carrying over certain legal concepts from the Portuguese Era (such as Code of Communidades and Co-ownership laws). Performing exhaustive legal due diligence is vital before signing a sale agreement or wiring funds.
Core Due Diligence Actions
1. Verify the Form I & XIV (Title Document)
This document lists the owner, the survey number, the area of the land, and the classification of crop. Buyers should check:
- Owner Column: Buyers should verify with counsel that all co-owners are listed. If the land belongs to a family joint property, every co-owner should sign the Sale Deed to prevent future litigation.
- Other Rights Column: Check if any bank mortgages, leases, or tenant rights (Mundkars) are recorded.
2. Verify the Sanad (Land Conversion Certificate)
Under the Goa Land Revenue Code, agricultural land generally cannot be used for residential construction without a conversion certificate (Sanad). A Sanad/conversion document may evidence permitted non-agricultural or settlement use, but buyers should verify land classification, zoning, approvals, and current records through counsel.
3. Check the Regional Plan Zone
Inspect the published Goa Regional Plan (RP-2021) maps for your survey number. For residential development, the land is typically expected to be designated as Settlement. If the map designates the plot as Orchard, Paddy Field, Forest, or CRZ No-Development Zone, classification restrictions can block, delay, or restrict building permission depending on approvals, categorization, and authority interpretation.
The CRZ Boundary Checks
If the villa is located near the sea or tidal rivers (common in Candolim, Vagator, Anjuna, and Morjim), buyers are advised to verify Coastal Regulation Zone (CRZ) constraints. Coastal properties may fall under CRZ restrictions depending on published HTL/CRZ mapping, classification, existing structure status, and GCZMA/local authority interpretation. Buyers should obtain site-specific CRZ advice before relying on development potential.
Summary Checklist for Villa Buyers
Before executing the final sale deed, buyers should verify with counsel that they have secured:
| Document Name | Verification Goal | Risk of Omission |
|---|---|---|
| Form I & XIV (Recent copy) | Confirm clear, unencumbered ownership track | Co-owner disputes / Undisclosed loans |
| Sanad Certificate | Confirm agricultural conversion approval | Illegal structure / Demolition order |
| Zoning Certificate | Verify "Settlement" classification in Regional Plan | Construction banned (Orchard / Forest zone) |
| Occupancy Certificate (OC) | Confirm municipal/panchayat building completion approval | No water/power meters / Illegal residency |

Further questions.

What is a Mundkar claim on Goan land?
Mundkar or tenancy-related claims can materially affect possession, transferability, and title comfort. A buyer should require a legal title search and local due-diligence review.

Coastal properties may fall under CRZ restrictions depending on published HTL/CRZ mapping, classification, existing structure status, and GCZMA/local authority interpretation. Buyers should obtain site-specific CRZ advice before relying on development potential.
