SILVER SANDS / TERMS
Terms, with useful clarity.
How to use the site, interpret temporary property examples and understand the basis of a real engagement.
Updated 10 October 2026In this document
Use of this website
- Use the site for genuine inquiry, research, and contact only.
- Personal research, sharing links, accessible browsing and ordinary search indexing are permitted. Do not commercially republish protected content without the necessary rights or misrepresent your affiliation with Silver Sands.
- Do not rely on site copy as a substitute for legal, tax, or title advice.
- Do not attempt to interfere with the website, form delivery, hosting infrastructure, analytics, security checks, or any private communication system used by Silver Sands.
Listings and availability
- All property records currently shown, including public listings and private folios, are temporary fictional examples while the collection is refreshed. Names, prices, locations, measurements, imagery, map markers and status labels are demonstration data, not live inventory or verified facts.
- A displayed example is not an offer, reservation opportunity, owner mandate or representation that a property is available. Do not make a payment or travel decision on that basis.
- Contact Silver Sands with your real brief. Any real opportunity requires separate confirmation of authority to market, availability, price, particulars and applicable approvals.
- The Property disclosure explains how to interpret examples.
Communications
- Submitting an inquiry does not guarantee representation or access.
- We may ask for clarification or decline work outside our scope, where authority is unclear or where a request is abusive or unlawful. An initial exploratory enquiry does not itself create a representation agreement.
- You remain responsible for the accuracy of the information you submit.
- An enquiry acknowledgement, brochure or viewing invitation does not by itself accept a mandate or bind an owner. A specific exchange can nevertheless have legal effect where it satisfies applicable requirements; do not assume that an email is non-binding merely because it is electronic. Confirm scope and authority before relying on an acceptance.
No public listing promise
- For an accepted assignment, we agree with the owner whether the home will be publicly listed, introduced privately or shared in stages.
- Public visibility, portal publication, social media exposure, and campaign timing are not guaranteed unless agreed in writing.
- Access to real private particulars depends on the agreed sharing permissions. An enquiry does not override the owner’s approved publication scope or a specific confidentiality arrangement.
Fees and commercial terms
- The displayed 1% seller model applies only where a clear-titled resale property is accepted under a written standard mandate. Scope, fee basis, payment trigger, applicable taxes and any exclusions must be agreed in writing before engagement.
- Displayed comparisons and fee calculators are arithmetic illustrations, not promises of savings or outcomes.
- Taxes, stamp duty, registration charges, government charges and independent professional or third-party costs are separate unless your agreement expressly includes them.
Buyer diligence
- Buyers should conduct independent diligence before making any decision, including title checks, approvals, zoning, access, built-up area, land records, taxes, society or association rules, and any other material issue.
- Silver Sands may assist with coordination, but responsibility for final purchase decisions remains with the buyer and their professional advisors.
- No website statement should be treated as a warranty about title, compliance, valuation, future returns, rental income, or development potential.
Seller representations
- Sellers and owner representatives are responsible for providing accurate ownership, title, approval, tax, encumbrance, pricing, and property-condition information.
- Silver Sands may choose not to proceed with a property if information is incomplete, inconsistent, or unsuitable for the intended private-market process.
- Marketing, photography, buyer introductions, or valuation discussion does not guarantee a sale, price, timeline, or buyer outcome.
No professional advice
- The website is not legal, tax, investment, architectural, engineering, or financial advice.
- You should consult qualified professionals before relying on any information connected with a property, transaction, tax position, ownership structure, or investment decision.
- Silver Sands may coordinate introductions to professionals, but their advice remains independent from this website.
Intellectual property
- Silver Sands retains the rights it holds in its original website content, imagery, code, animations and brand materials. Ownership claims and reuse restrictions apply only to rights actually held; licensed material remains subject to its applicable terms.
- Commercial reproduction of protected website material requires the relevant rights or permission. This does not restrict lawful personal browsing, assistive tools, ordinary indexing or reuse permitted by a third-party licence.
- Third-party images, fonts, icons, libraries, and services remain subject to their own licenses and terms.
Third-party services
- The site may rely on hosting, email delivery, analytics, font, image, map, communication, or security providers.
- External links such as Instagram, WhatsApp, Facebook, LinkedIn, email, or phone links are provided for convenience and may be governed by those platforms.
- Independent third-party sites control their own services, content and policies. This does not exclude our responsibility for our own instructions, representations or handling of your information, or any liability that applicable law does not permit us to exclude.
Site availability and performance
- We aim for reliable access across modern browsers. Maintenance, connectivity or third-party outages may affect availability.
- Animations may respond to reduced-motion settings and device capability. The reading content and enquiry route remain available.
- No term excludes liability or a remedy that applicable law does not permit us to exclude.
Limitation of liability
- The website is provided on an as-is and as-available basis.
- Catalogue examples and general guidance have the limits explained here and in the Property disclosure. Website availability or a third-party outage does not guarantee an outcome. Any liability limitation applies only where lawful; it does not excuse our own fraud, deliberate misrepresentation or breach of a non-excludable duty.
- Nothing in these terms limits liability where such limitation is not permitted by applicable law.
Indemnity and misuse
- Do not misuse the site, knowingly submit false information, impersonate another person, bypass access controls, harvest personal information or use it for spam, harassment or unlawful activity. Lawful browsing, assistive access and indexing remain permitted as described below.
- You may be responsible for losses caused by false submissions, unauthorised use of another person's details, infringement of intellectual property, or abuse of the website and communication channels.
- Silver Sands may block, ignore, preserve, or report abusive submissions where appropriate.
Disputes and governing approach
- Raise concerns with Silver Sands at goasilversand@gmail.com so they can be reviewed in good faith.
- Indian law applies subject to mandatory applicable law. Nothing here excludes statutory consumer rights, complaint mechanisms or a forum available under applicable law.
- A separate signed mandate governs an actual engagement to the extent legally permitted. Website terms do not substitute for a transaction agreement.
Changes to these terms
- We may update these terms as the site, services, contact process, fees, or legal requirements change.
- The updated date identifies the published version. Browsing after an update does not by itself accept a new fee, exclusive mandate, publication licence or unrelated data-processing purpose; any required notice and acceptance must be obtained separately.
How an engagement begins
- Browsing, saving a comparison or submitting a brief does not create an exclusive agency, legal advisory engagement or authority to negotiate binding terms in your name.
- For an accepted assignment, agree the scope, parties, responsibilities, duration, fees and authority in writing. A separate signed mandate governs that assignment subject to applicable law.
- Website descriptions explain our approach. Specific photography, advertising, travel, document coordination and other deliverables must be agreed for your property or search.
Offers and acceptance
- A listing, price label, viewing, shortlist or message introducing a property is not itself a binding offer to sell or a reservation.
- An offer must identify its material terms, conditions, approvals and parties. Do not assume that an owner accepted an offer because we received or forwarded it.
- Any binding sale, deposit, refund or possession arrangement must be documented with the appropriate parties and independent advice. Silver Sands cannot bind an owner without the necessary authority.
Fees, taxes and expenses
- The advertised 1%* buyer and 1%* seller fees describe the standard model subject to accepted mandate terms. Confirm the fee basis, liable party, payment trigger and any exception in writing before work begins.
- Stamp duty, registration charges, applicable taxes, lender costs, legal fees, survey costs and other transaction expenses are separate from brokerage unless expressly included. Estimates and calculators are indicative.
- Any additional photography, marketing or other expense should be agreed before it is incurred. Applicable tax treatment and invoice details depend on the actual engagement and law; the website does not determine your tax liability.
- Cancellation, termination, refund and introduced-party provisions should be explicit in the signed engagement. This website does not impose an undisclosed cancellation charge.
Payments and fraud prevention
- Do not pay for a fictional example, and do not send a deposit merely because someone claims a website price or map marker reserves a home.
- Verify the recipient, authority, written terms and bank details through a previously confirmed contact before making a real payment. Treat a last-minute change of bank details as requiring independent verification.
- We do not ask for your passwords, one-time banking codes or remote control of your device through the site. Report suspicious messages to the published desk contact.
- Only the relevant written agreement can establish whether money is a deposit, brokerage payment or reimbursable expense and what refund conditions apply.
Viewings and access
- Visits depend on owner permission, scheduling and any agreed qualification or safety requirements. A requested time is not confirmed until the desk confirms it.
- Respect occupants, staff, neighbours and the property. Obtain permission before taking photographs, recording a visit, operating a drone or sharing a private address.
- Tell us about access requirements before a visit. Physical conditions, transport and weather can affect access; we can discuss arrangements but cannot guarantee every site is accessible to every visitor.
Seller materials and photography
- If you provide photographs, floor plans, descriptions or documents, you must have the authority and permissions needed for the agreed use. Identify third-party credits, restrictions and expiry dates.
- Permission for marketing must identify the agreed representation and publication purposes, relevant channels and duration. Providing material for an initial enquiry is not a transfer of ownership or permission to publish it publicly.
- When we arrange photography, its cost, licence, publication channels, duration and permitted reuse should be agreed with you and the photographer. We do not promise ownership of every commissioned image.
- We may correct, withhold or remove material that is inaccurate, unauthorised or no longer approved. You can ask for an update or removal through the desk.
What Private Collection means
- The Private Collection is being refreshed. It is intended to present suitable homes by introduction, including homes whose asking prices are not published. The label alone does not mean that a property is exclusive, confidential or absent from every other channel.
- Availability, identity, price and the permission to share particulars must be confirmed for a real opportunity. No specific allocation, discount or access is guaranteed by an enquiry.
- Any restriction on onward sharing must be stated for the information concerned. This general label does not create an unlimited confidentiality obligation.
Independent advice and competing interests
- You choose your own lawyer, surveyor, tax advisor, lender and other professionals. A suggested introduction is not a guarantee of their work or independence.
- An introduction or coordination service is not title certification, legal representation, a valuation report or a structural warranty.
- Buyer and seller engagements can involve different interests. Any material role, fee arrangement or conflict relevant to your assignment should be explained before you rely on advice or representation.
Permitted access and content reuse
- You may browse, use accessible assistive tools and share links for personal property research. Ordinary search-engine indexing and lawful navigation by AI assistants do not require a separate permission merely because they are automated.
- Do not bypass access controls, collect other users’ information, overload the service, impersonate the desk or reuse content commercially in a way that infringes rights actually held by Silver Sands or a third party.
- Some assets are licensed or AI-generated. These terms do not assert an exclusive copyright in material where such a right does not exist, restrict rights granted by a third-party licence or declare a pending trademark registered.
- Brand references must not suggest endorsement or affiliation that does not exist. Contact the desk about authorised commercial reuse.
Corrections and complaints
- If you notice an inaccurate statement, broken feature, unauthorised image or misleading property detail, email the desk with the page address and a clear description.
- We may ask for proportionate supporting information, investigate the relevant material and correct or remove it as appropriate. A complaint is not an agreement to suppress lawful criticism.
- Where a dispute concerns a specific mandate, identify that engagement and the remedy sought. Any applicable consumer, regulatory or other statutory route remains available.
Statutory rights and enforceability
- Nothing here excludes liability or remedies that cannot lawfully be excluded, or excuses fraud, deliberate misrepresentation or an applicable statutory duty.
- A disclaimer does not turn a false factual statement into a lawful statement. Actual advertising, publication and brokerage activity must satisfy the law applicable to that activity.
- If a provision cannot be enforced, the remaining terms apply only to the extent lawful. These terms do not require you to waive access to an authority, tribunal or court that the law makes available.
- Website changes do not retrospectively rewrite an accepted mandate or remove an accrued right. Material engagement changes require the agreement and notice required for that engagement.
Document priority and the parties
- “Silver Sands”, “we” and “the desk” refer to the business using the Silver Sands Real Estate name and the contact details published on this site. Your real engagement must identify its actual contracting party, service address and authorised signatory; a brand name alone does not identify a legal entity or its registration status.
- These terms govern website use. The Privacy notice explains personal-information handling, and the Property disclosure explains catalogue and property information. Read the relevant documents together; no one of them overrides mandatory law.
- An accepted written mandate governs its specific services, fees and responsibilities to the extent lawful. If website wording and a proposed mandate differ, clarify the difference before accepting it. A webpage update does not retrospectively alter an accepted engagement.
- A property sale or transfer is governed by the appropriate parties’ transaction documents and required legal formalities. Website terms, an enquiry reference and a brokerage mandate do not replace a sale deed or make the desk the owner, developer, lender or legal adviser.
Mandate duration, cancellation and ending work
- Before a real assignment begins, the mandate should identify its start, duration, deliverables, review arrangements and any exclusive or non-exclusive scope. There is no exclusive appointment merely because you submit a website form.
- Agree termination notice, cancellation, refunds and the treatment of completed work or authorised expenses in the mandate. This page does not invent a non-refundable advance, automatic renewal or charge for withdrawing an initial enquiry.
- Any fee relating to a person introduced during a mandate must identify the relevant introduction, duration and conditions in an accepted agreement. These website terms do not impose an unlimited post-termination fee or prohibit you from dealing with other people.
- When an assignment ends, clarify remaining document access, approved publications and outstanding obligations. Lawful accrued rights remain; cancellation does not grant unlimited reuse of confidential information or photographs.
Remuneration, referral payments and conflicts
- Our standard model describes a 1%* buyer fee and a separate 1%* seller fee, subject to the accepted engagements. For a real assignment, confirm who is paying us, for what work and when. Do not assume that paying one party’s fee pays the other party’s fee.
- Any material payment, commission or referral benefit from a developer, lender, professional or other participant relevant to your assignment should be disclosed before you rely on the recommendation. This clause does not assert that such a payment exists in every transaction.
- Representing or coordinating with both sides can involve differing interests. Clarify our role, authority, confidentiality responsibilities and any necessary consent before negotiations; the website does not grant unrestricted authority to favour one party at the other’s expense.
- A recommendation is not an obligation to use that provider. You may obtain independent advice and compare written quotations. Any claimed fee saving requires a like-for-like comparison of services, tax treatment and each party’s actual charges.
Content licences and rights complaints
- Submitting materials for an enquiry allows the handling needed to review and respond to that enquiry; it does not grant a perpetual worldwide publication licence. Public marketing, editing, reuse, recipient channels and duration should be authorised separately for the assignment.
- Photography or image generation does not by itself transfer every intellectual-property right to us or you. Identify photographer licences, model or location permissions, third-party credits and any limitations relevant to the agreed publication.
- For a rights complaint, provide the page or asset link, identify the rights claimed and supply proportionate supporting information and a reply contact. Do not publish sensitive identification documents or another person’s personal information to make the complaint.
- We may restrict the disputed material while reviewing a credible report, seek further information and correct or remove it as appropriate. A report does not automatically prove ownership, authorise disclosure of confidential records or remove lawful licence and statutory exceptions.
Limits on exclusions and complaints
- Read website limitations in their specific context. They do not create a blanket waiver of our responsibility for our own misleading statements, negligent service where liability cannot lawfully be excluded, or an obligation accepted in a real engagement.
- No arbitrary claim deadline, mandatory private arbitration, class-action waiver or exclusive complaint forum is created by these website terms. Applicable statutory limitation periods, consumer remedies and competent courts or authorities remain available.
- Raising a complaint with the desk is an available first step, not a contractual condition that prevents urgent action or automatically extends a legal filing deadline. Keep relevant communications and seek advice on any time-sensitive matter.
- Any responsibility for misuse must relate to the person’s actual unlawful or unauthorised conduct, causation and recoverable loss under applicable law. These terms do not require you to indemnify our own wrongful conduct, an unrelated third-party loss or every complaint made against us.
